Cosmetic Labeling Requirements

The Food and Drug Administration (FDA) defines the difference between cosmetics and drugs in the Federal Food, Drug, and Cosmetic Act (FD&C Act). And, sometimes products fall under both categories. For instance, moisturizing personal care products, such as lip balms, scented lotions, and antiperspirant deodorants, are deemed both drugs and cosmetics.

Incorrect information can result in your product being labeled as misbranded and lead to time to market delays. Don’t risk it!

Quick FDA Cosmetics Labeling Guide

The code of federal regulations for cosmetics and other consumer goods was established in the Fair Packaging and Labeling Act. Cosmetic regulations state the following information must be included on the outer package:

  • Brand and product name
    • Cannot include any ingredient names
  • Net quantity of contents
    • For liquids, volume in gallons, quarts, pints, or fluid ounces
    • For solids and semisolids, net weight is stated in customary and metric units
  • Identity statement
  • Safe-use directions and intended use
  • Any applicable warning statements, such as inclusion of aerosols
  • Ingredients declaration
    • Cosmetic ingredient labeling should be done in order of predominance with the highest to lowest listed in descending order
    •  Color additives must appear at the end of the ingredient list and be approved by the FDA
    • If the product is also considered a drug, active drug ingredients must be declared before cosmetic ingredients
  • Information about your place of business: street address must be included
  • Country of origin
